SAM.AI by Carmaa — Legal
Acceptable Use Policy
Rules governing your use of SAM.AI — incorporated into the Terms of Service.
This Acceptable Use Policy governs your use of SAM.AI. By using the Service you agree to it. We may update it from time to time. Violations may lead to suspension or termination (Terms §9, §16).
1. General
You must use SAM.AI lawfully, honestly, and only for legitimate business communications with people who have agreed to hear from you. You are responsible for everything done through your account and for your Contacts’ and End Users’ experience.
2. Messaging, Consent & Anti-Spam
Because SAM.AI sends messages on your behalf (including via WhatsApp) and can run automated follow-ups/retargeting, you must:
- Obtain valid opt-in/consent from every Contact before messaging them, as required by law and by Meta/WhatsApp policies. Keep records of consent.
- Honour opt-outs promptly (e.g. “STOP”/unsubscribe requests) and do not message people who have opted out.
- Not send spam, bulk unsolicited messages, or messages to purchased/scraped/harvested lists.
- Comply with WhatsApp/Meta policies, including the WhatsApp Business Messaging Policy and Commerce Policy, message-template rules, and quality/rate limits. Repeated low-quality sending can cause Meta to restrict your number — that is your responsibility.
- Comply with applicable telecom/marketing laws (e.g. India’s TRAI/DND framework, and laws like TCPA/CAN-SPAM/GDPR/ePrivacy where relevant to your audience).
3. Prohibited Content & Conduct
You must not use SAM.AI to create, send, store, or facilitate:
- Illegal, fraudulent, deceptive, or misleading content; scams or phishing.
- Harassment, hate speech, threats, or content that is defamatory, obscene, or violent.
- Sexual content involving minors, or any exploitation of minors.
- Infringement of intellectual-property, privacy, or publicity rights.
- Malware, or attempts to disrupt, probe, or gain unauthorised access to the Service or others’ systems.
- Sensitive-sector messaging that violates applicable restrictions (e.g. unlawful financial, pharmaceutical, gambling, or adult content).
- Collection or processing of special-category/sensitive personal data without a lawful basis and appropriate safeguards.
4. AI Use
- Do not configure the AI agent to impersonate a person in a deceptive way, to give regulated professional advice it is not authorised to give, or to produce prohibited content (§3).
- You are responsible for reviewing and supervising AI output and for using human handover where appropriate.
- Do not attempt to use the Service to reverse-engineer, extract, or misuse underlying models or another party’s data.
5. Fair Use & Platform Integrity
- Do not exceed plan limits through automation designed to evade metering, share a single account across unrelated businesses to avoid fees, or resell the Service without authorisation.
- Do not interfere with the Service’s operation or other customers’ use (e.g. excessive load, security testing without permission).
6. Third-Party Compliance
You must comply with the terms and policies of every Third-Party Service you connect (Meta/WhatsApp, Google, LinkedIn, your AI provider, Razorpay). A breach of their policies is also a breach of this AUP.
7. Enforcement
We may investigate suspected violations and may remove content, throttle, suspend, or terminate access, with or without notice where necessary to protect the Service, comply with law, or satisfy a Third-Party Service requirement. We may report unlawful activity to authorities.
8. Reporting
